Terms & Conditions




TERMS OF BUSINESS

Effective immediately until further notice, the terms and conditions of Be Inspired Gyms are as follows:

Agreement Commencement:

  1. This agreement commences upon the following conditions:
    • If you are on Be Inspired Gyms premises, by indicating acceptance in the declaration section of this sign-up process.
    • If you are not on Be Inspired Gyms premises, by indicating acceptance in the declaration section of this sign-up process before entering Be Inspired Gyms premises or after a period of 7 days has elapsed – whichever is earlier.

Membership:

  1. Membership commences immediately upon agreement, granting all rights and privileges for the chosen membership type.
  2. Membership is available to individuals 16 years or older.
  3. Membership is non-transferable.
  4. Be Inspired Gyms reserves the right to reject any application or renewal of membership without explanation.

Fees and Charges:

  1. Membership fees include a non-refundable first payment due before gym entry and a commitment to a minimum number of Direct Debit payments each month, payable regardless of attendance; unless you opt for the monthly rolling Non-Contract option. Failure to pay will result in suspended membership until dues are cleared.
  2. Cancelling membership incurs a £50 charge in addition to arrears. Membership renewal fees may change with at least 30 days’ notice.

Membership Renewal:

  • Membership fees may be adjusted as needed, with at least 30 days' notice before any changes. Membership is automatically extended monthly after the initial Direct Debit commitment is met, unless cancellation is requested eight weeks before the renewal date. Direct Debit arrangements can only be altered with at least 14 days' written notice from Be Inspired Gyms.

General Terms of Membership:

  1. Members must not compromise security or safety.
  2. Members must adhere to the Rules of Membership displayed within the gym.
  3. Be Inspired Gyms may change rules or terminate memberships based on conduct.
  4. Members accept health and physical condition responsibilities.
  5. Members must disclose any disabilities to prevent accidents.
  6. Health or medical condition changes must be reported to staff.
  7. Members are entitled to a complimentary induction upon request but assume risk if declined.
  8. Parking is available, with priority for disabled users. Be Inspired Gyms is not responsible for loss or damage to vehicles or property.
  9. Entrance is through the reception only.
  10. No pets allowed, except guide dogs and wheelchair access.
  11. Misuse of equipment may lead to expulsion and financial responsibility for damages.
  12. Equipment removal from premises is prohibited.
  13. Personal items must be stored in lockers, at the owner's risk.
  14. Loss or damage to a locker fob incurs a £20 charge.
  15. Be Inspired Gyms may amend terms without prior consent but will notify members of changes.

Member Consent, Waiver, and Release from Liability:

  1. Members acknowledge and indemnify Be Inspired Gyms against personal injury and property damage risks.
  2. Members waive the right to claim against Be Inspired Gyms for self-injuries or physical health conditions.
  3. Consent is given for staff assistance and emergency services as needed.
  4. Members consent to release Be Inspired Gyms from all liabilities.
  5. Members affirm good health and no medical advisories against gym activities.
  6. Members must report unsafe conditions immediately.
  7. Members assume all participation risks and indemnify Be Inspired Gyms against claims.
  8. Intoxication on premises is prohibited, with the expectation to vacate if under the influence.

  10. Penalty for Policy Violations:

    Be Inspired Gyms imposes a irrevocable £500.00 fine for sharing access codes, unauthorised entry, or any form of policy abuse. Violators will be permanently banned without refund and fined. Outstanding penalties will be pursued by a debt collection agency on our behalf, with members liable for additional collection fees. This measure ensures the safety and integrity of our facilities for all paying members.

Data Protection and Privacy:

  • Privacy Policy: We are committed to protecting your privacy and personal information. Information collected during sign-up and membership is processed in accordance with applicable data protection laws. Members have the right to access, correct, or delete their personal data. Health and Safety:

  • Emergency Procedures: All emergency fire exit points are clearly labeled and shown within the facility. Members are advised to familiarize themselves with these exit points upon their first visit.
  • Infection Control Policy: To ensure the health and safety of our community, we adhere to rigorous infection control policies, including enhanced cleaning protocols, availability of hand sanitizers, and guidelines for members to follow if feeling unwell. Please adhere to posted guidelines to help us maintain a safe environment.

Technology Use:

  • Wi-Fi Use: Complimentary Wi-Fi is available for members. Use is subject to terms that prohibit illegal activities and downloads. The gym is not responsible for the security of data transmitted over the gym's network.
  • CCTV and Photography: CCTV is in operation for the safety and security of all members. Personal photography or recording is permitted but must respect the privacy of others. Publishing images/videos of other members/staff without consent is prohibited.

Additional Services:

  • Personal Training (PT) Bookings: PT sessions cannot be cancelled within 48 hours of the booking. Cancellations within this period will result in the loss of the appointment credit, and all bookings are non-refundable.
  • Classes and Induction: Induction to the gym's facilities and equipment is available via an access video. Members are encouraged to complete this induction to ensure safe and effective use of the gym.

Dispute Resolution:

  • Complaints Procedure: Complaints should be submitted through our website. We are committed to addressing and resolving complaints in a timely and fair manner.

Intellectual Property:

  • Rights Reserved: All intellectual property rights, including trademarks, branding, and content of Be Inspired Gyms, are owned by us. Use of our intellectual property without explicit permission is strictly prohibited.

Member Consent, Waiver, and Release from Liability:

  • Acknowledgment of Risk and Waivers: Members acknowledge the inherent risks associated with physical exercise and use of the gym's facilities. By agreeing to these terms, members waive the right to hold Be Inspired Gyms liable for any injury or damage sustained, except in cases of negligence by the gym.
  • Disclaimers: Be Inspired Gyms disclaims liability for personal injury or property damage as far as legally permissible. Members are responsible for their own health and safety.

Amendments:

  • Changes to Terms: Be Inspired Gyms reserves the right to amend these terms and conditions. Members will be notified of significant changes via email or postings in the gym.

Assignment of Agreement:

  • Be Inspired Gyms reserves the right to assign this agreement to a third party with notice, without prejudicing member rights.

These terms are binding upon acceptance and ensure a safe, respectful, and enjoyable gym environment for all members.
